
Terms of use of Energy Monitoring Platform
1. General Terms & Conditions
1.1. The Energy Monitoring Platform (EMP) is an energy management system support tool especially designed for cities and municipalities, and is available only for registered EMP Users.
1.2. The EMP is available in 8 EU countries (LV, DE, HU, ES, IT, FR, CY, HR) for cities and municipalities on respective national language. The EMP is developed in framework of EU project Compete4SECAP, and is co-financed by European Union’s Horizon 2020 Research and Innovation Programme under Grant Agreement No 754162. However, the information on this EMP does not necessarily represent the view of the European Commission.
1.3. The EMP system is maintained, updated and hosted by a private company “EKODOMA” Ltd., located in Riga, Latvia. The day-to-day support on use of EMP is provided by the respective national partner in each country. 1.4. The Terms and Conditions of the EMP determine creation of city or municipality account and User accounts as well as the basis for responsibility for failure to comply with these Terms and Conditions and other rules that are binding to Users of the EMP.
1.5. EU project Compete4SECAP consortium reserves all rights to make amendments to the Terms and Conditions of the EMP, publishing them in the following Internet address: link to the EMP. The EMP Users shall become acquainted and comply with these Terms and Conditions.
2. How to become a registered User of the EMP?
2.1. The Users of the EMP can be registered only if an count for respective city or municipality is created. The city or municipality account can be created only by the respective national partner. In order to create an account for your city or municipality, please contact your national contact point.
2.2. Two levels of User account exist: 1st level – responsible person from a city or municipality, operating the city or municipality account; 2nd level – responsible person for one or more objects (public buildings, public lighting stage, etc.) within the city or municipality, and operating these defined objects.
2.3. To become a registered User of the EMP a new User account is created, and a username and password is received. The 1st level User account is created by the national contact point. The 2nd level User can be created by the 1st level User from the respective city or municipality. In order to create 1st level User account, please contact your national contact point.
2.4. The User account can be activated only by the User himself/herself; therefore, an e-mail message with an activation link is sent to the indicated e-mail address to finalize the registration process and activate the User account.
3. Truthfulness of data and basis of responsibility
3.1. By approving the Terms and Conditions of the EMP at the stage of registration to the EMP the User agrees, that EKODOMA Ltd. will carry out processing of personal and city or municipal data transferred through the EMP according to the existing regulatory enactments.
3.2. User, who registers on the EMP, confirms that the submitted data, including personal data, are true and there is a legal basis for their processing, otherwise the User shall assume responsibility for using personal data of another person and it may be held liable according to the procedures specified in laws, and claims can be filed against this person concerning any damage incurred because of such illegal conduct.
3.3. By transferring personal data for processing to EKODOMA Ltd., the User shall assume responsibility for obtaining of consent from corresponding data subjects, if this is not personal data of the User.
3.4. EKODOMA Ltd. shall process personal data of individuals obtained from the User only for the purpose to ensure the fulfilment of mutual obligations, taking into account the requirements for processing and protection of such data laid down in regulatory enactments.
3.5. EKODOMA Ltd. shall be entitled to terminate User's access to the EMP immediately, if violations of these Terms and Conditions and requirements of regulatory enactments are detected.
3.6. EKODOMA Ltd. shall undertake upon the User's request to delete personal data of individuals obtained from the User, if the necessity to process them has ceased.
4. Deletion of User account
4.1. The city or municipality account can be deleted by the national contact point upon the request of city or municipality legal representative.
4.2. The 1st level and 2nd level User account can be deleted by the national contact point upon the User request. The Users account deletion is aligned with the legal representative of respective city or municipality.
4.2. The 1st level User of the city or municipality account can delete 2nd level Users account of the city or municipality account in the EPM section Users.
5. Safety requirements while using the EMP
5.1. The use of EMP is possible without providing sensitive personal data. Personal data, such as names or e-mail addresses, are always provided on a voluntary base. Those data as well as city or municipality data will not be passed on to third parties without Users, city or municipality explicit permission.
5.2. Secure data exchange between the User computer and the EMP is ensured by SSL (Secure Sockets Layer) data exchange protocol. However, no data transmission via internet (e.g. e-mail communication) can be entirely secure and may have security vulnerabilities.
5.3. When starting the use of the EMP, it is recommended to always verify, whether this connection is correct. This is confirmed by a lock, which is displayed in the browser window and the combination of letters https at the beginning of the EMP address – https://www.energoplanosana.lv
5.4. To open the security certificate verification window, User can click on the key icon. The User shall verify, whether a correct address (Issued to www.energoplanosana.lv) and certificate issuer company (Issued by Daddy Secure Certificate Authority – G2) is indicated in the certificate and whether the term of validity of certificate (Valid to) has not expired.
6. Requirements for computer protection
6.1. In addition to secure data exchange guaranteed by SSL protocol, we recommend that Users manage the condition of their computer on regular basis:
6.1.1. accepting requests for regular updates of antivirus programs and operating systems;
6.1.2. installing a firewall – a program, which controls data flow between the customer computer and computer network;
6.1.3. checking the computer on existence of various unwanted programs.
6.2. In order to ensure, that there are no any potentially hazardous programs on the computer, we recommend using free online antivirus verification methods.
6.3. In order to be able to fully use the options offered by the EMP, we recommend using the following browsers:
• Google Chrome 35 and the latest version;
• Mozilla Firefox 30 and the latest version;
• Internet Explorer 10 and the latest version;
• Android Browser (starting from “Jelly Bean” version or later) - for all devices equipped with Android operating system.
7. Copyright
7.1. The EMP is a property of EKODOMA Ltd. All creative developments published on the EMP, including design, texts and software code, are property and subject of copyright of EKODOMA Ltd. and EU Compete4SECAP project consortium, and are protected pursuant to the procedures determined in legislation of the Republic of Latvia.
7.2. The copyright for any material created for the EMP is reserved. Any duplication or use of objects such as diagrams or texts in other electronic or printed publications is not permitted without the project consortium's agreement.
8. Legal validity of this disclaimer
8.1 This disclaimer is to be regarded as part of the internet publication which you were referred from. If sections or individual terms of this statement are not legal or correct, the content or validity of the other parts remain uninfluenced by this fact.
